The Delhi High Court chastises Twitter for non-compliance and demands a “better affidavit”

The Delhi High Court chastised Twitter on Wednesday for failing to comply with the new IT Rules 2021 and gave it one week to file a “better affidavit.”

The court said the affidavit must clearly outline the names of the people who have been appointed as Chief Compliance Officer and Redressal Officer before adjourning the case to August 6.

The affidavit will also state why a nodal contact person has not yet been appointed and when he will be appointed.

During the hearing, Twitter’s counsel Senior Advocate Sajan Poovayya informed the court that it had appointed a Resident Grievance Officer and Chief Compliance Officer and was in the process of appointing a Nodal Contact Person through a third party contractor.

However, Justice Rekha Palli objected to Twitter’s use of the term “contingent worker” in its affidavit. She stated that it sounded like there was a backup plan.

The judge also stated that if Twitter wishes to comply with the Information Technology Rules, 2021, it must do so wholeheartedly.
