Unborn child has the Right to Life, says Kerala High Court

Kochi: The Kerala High Court has ruled that under Article 21 of the Constitution, an unborn child has the right to life.

According to Justice P B Suresh Kumar, the unborn child has its own life and rights, which are recognised by the law.

A petition filed by an Ernakulam native seeking to terminate a 31-week pregnancy was denied by the court.

According to the petition, the foetus was diagnosed with significant abnormalities. The woman had gone to the hospital to have her pregnancy terminated. However, because the legally mandated time limit had passed, the hospital administration had denied her request for an abortion.
The woman then walked up to the court.

The petition was dismissed by the High Court after the medical board submitted a report stating that, while the foetus had abnormalities, they were not serious and did not endanger the mother’s life.

In addition, the High Court ruled that an unborn child does not need to be distinguished from a newborn.
