Experts say it’s difficult to cancel a licence after talking on Bluetooth while driving.

Thiruvananthapuram: According to some legal experts, even if the driver is caught talking on a Bluetooth device while driving, it will be difficult to cancel the licence. The police recently informed me that if a driver is caught talking on Bluetooth, his or her licence may be revoked. However, experts say that due to legal issues, this will not be possible.

The Motor Vehicle Act section 184 defines dangerous driving as “using mobile phone with hands.” However, in the 2019 amendment, this was changed to ‘communication devices used with hands.’ In addition, more points have been added to the definition of dangerous driving.

However, the only punishment for all of this is imprisonment and a fine. Previously, the fine was Rs 1000, but it was raised to Rs 10,000. A six-month prison sentence is also part of the punishment. The police also admit that the Motor Vehicle Act needs to be amended in order for the licence to be revoked for this offence.

States do not currently have the authority to amend the act. Even if the licence is revoked, the case will almost certainly be dismissed by the court. As a result, there is some uncertainty about how to carry out the police directive.

T G Gokulnath, the enforcement RTO, stated that using a phone while driving impairs concentration and can lead to an accident. People must be more attentive when talking on the phone rather than speaking to someone nearby. As a result, it is preferable to avoid using a phone in any way while driving a vehicle, he added.
