Abu Dhabi: For the many Indian expatriates working in the UAE, conducting financial transactions through local banks is a common necessity. However, the UAE’s strict legal environment requires careful attention to detail, especially when it comes to issuing or receiving cheques. Even a seemingly small mistake, such as a signature mismatch, can lead to severe consequences, including hefty fines and imprisonment.

If a cheque bounces due to a mismatched signature, the penalty can be steep. The individual responsible will face a bank charge as well as a legal fine of 5,000 Dirhams (around ₹1,14,077), and could be sentenced to imprisonment for a duration ranging from six months to two years. This underscores the importance of ensuring accuracy when handling cheques in the UAE.

Certain essential details must be included on a cheque to avoid complications:

  1. The word “Cheque” in the same language as the cheque itself (e.g., in English).
  2. The name of the account holder.
  3. The name of the payee (the person receiving the funds).
  4. The place of issue (where the cheque is drawn).
  5. The date of issue (when the cheque can be cashed).
  6. Most importantly, the signature of the issuer.

A mismatched signature can result in significant financial and legal penalties. The fine can even double the amount mentioned on the cheque but will not exceed twice its value. Additionally, if the account is closed or funds are withdrawn before the cheque’s cashing date, the penalties still apply. Therefore, expats need to exercise caution to avoid costly mistakes that could disrupt their lives.
